Plant varieties and animal breeds

Creativity in selection leads to genesis of new biological species, which can possess high commercial and humanitarian value: innovations in agriculture have a positive effect on food security, quality of nutrition and safety of pharmaceuticals made of plants. New varieties of plants and animal breeds created as a result of selection can be protected by a patent in accordance with the local requirements.

Holders of patents for plant varieties and animal breeds can benefit from granting licenses to farming enterprises for using agricultural innovations. The name of a patented variety or breed is also protected and cannot be used for another selection product. Generally, to be granted a patent, a selection achievement should comply with the criteria of novelty, distinctness, uniformity and stability. The validity period of patents for grapes, ornamental trees, fruit crops and forest species can reach up to 35 years.

Examination procedure depends on the variety applied for protection in a particular jurisdiction. For example, the Civil Code of the Russian Federation allows performing the examination based on the data furnished by the applicant in accordance with the national standards or on DUS (Distinctness, Uniformity and Stability) testing results obtained by a specialized foreign authority. In most cases, the procedures of examination and patent grant do not require submitting plant or animal material. However, variations of procedure for different cases, the absence of facilities for electronic communication and further peculiar requirements of the local regulations in this field may hinder the procedure for an applicant. Patentica’s specialists have extensive experience of patenting a range of varieties and will be glad to assist you with the process.

There are additional local requirements to consider. For instance, in some countries, in order to grow or propagate a culture, it is obligatory that it is registered with the national registry of allowed varieties, confirming, among else, its serviceableness and capacity to be cultivated in regions with different climate conditions. This examination can also be performed based on data provided by the applicant. Our specialists can provide you more details regarding these matters and share their experience to support you throughout the application filing and examination process in the country of the applicant’s interest.

Software and IT

The global information technology (IT) industry was valued at approximately 5 trillion dollars in 2021. Today literally all economic sectors are dependent on computer technologies, especially when it comes to extending a company’s reach to the e-commerce market, introducing automation and enhancing the operational qualities of equipment. Fierce competition and rapid development of the market ignite numerous game-changing innovations.

Applicability of the inventions in the sphere vary from semiconductors, 3D printing technologies (for example, 3D printer hardware features, printing methods and materials could be registered as utility models), CAD processes, DNA mapping, microprocessors, optics, GPS systems, diodes, RFID technologies, robotics to, of course, software (under certain conditions), artificial intelligence (AI), augmented and virtual reality and many more.

As for computer programs, it is worth mentioning that a code is generally protected under copyright (although in some jurisdictions state registration is also available), while the functional aspect of software, such as computer-implemented algorithms, systems and processes with technical features that aim to solve a technical problem, can be patentable as inventions.

Another way to protect rights to a computer program is state registration of the code. You can learn more about in the Computer Programs section(click here).

PATENTICA’s teamwork secure proper analysis of patentability with due regard to the local legislation requirements, based on which we can propose relevant types of protection (by a utility model, invention or industrial design or computer program patents or copyright). Cross-disciplinary competence of our attorneys also ensures high quality and multifaceted strategies.

Electrical Engineering

We cannot imagine our lives without so many modern inventions, and above all without the electronic and electrical devices, such as computers, telephones and GPS navigators. Covering vast areas of technologies, inventions in this field contribute to their development, safety and sustainability and bring closer the future from science fiction, where virtual reality helps in rehabilitation, smart homes are controlled by mere voice commands, shipments are delivered by robots, and air taxis are tested.

We deal with the inventions touching upon such technologies as virtual and augmented reality, batteries, electrodes, semiconductors, drones, wearable devices (e.g. smartwatches), robotics, green energy electrical power converters, electric vehicles, wireless charging devices, smart grids, energy-storing supercapacitors and others.

Our Electronic Engineering team collaborates with attorneys from other divisions from Mechanics to Biotechnology depending on the invention subject matter to provide meticulous and comprehensive analysis. We also keep constantly developing our skills and knowledge to keep up with the cutting-edge innovations out of both natural inquisitiveness and pursuit for top-notch service for our clients. This is why sometimes discussions between an inventor and our specialists result in further evolution of the inventor’s idea and even give birth to new ideas.

Mechanical Engineering

We live in a world where automation is making domestic life and industries more effective, effortless, dependable and fast-paced. Engineering innovations encompass all technological fields from household appliances to aerospace construction, involving computer-implemented inventions.

We work with innovations in biomedical engineering, microelectromechanical systems (MEMS) nano-engineering, machine tools, transport, food, paper, aerospace, automotive, subsea, environmental, nuclear and the construction industries. The range of inventions here is ever evolving, and we support our clients in obtaining and enforcing their patents protecting motors, engines, turbines, detectors, systems and other developments.

Our clients are equally diverse, varying from individual inventors to large multinational companies, from domestic research institutions to overseas corporations and their external counsel, as well as several technology transfer centres.

Because of this diversity, we appreciate that each client has different requirements and that those requirements may change as they develop. Our service is therefore customised for the client’s requirements at a particular time. For some clients, we act almost as an in-house department, in direct contact with inventors, whilst for others we take instructions from an in-house patent attorney or patent coordinator.
