Designs
According to the current Russian legislation, a shape or configuration of a product can be protected as a registered design. However, unlike UK, a pattern or ornamentation itself cannot be protected as a registered design in Russia.
It is also very important to mention that a design right in Russia is not an automatic right like copyright. To allow you to protect your designs and prevent others from copying or misusing them you need to register your design and keep the design patent in force. In Russia and CIS countries, only registering a design provides protection to design right in comparison to copyright protection that may exist automatically.
The patentability of a design in Russia is established based on an image of an article and a set of essential features of the design.
Thus, to file a design application in Russia, the following documents shall be prepared:
- a description of a design;
- a set of essential features of the design; and
- images (drawings or photos) of the design.
The number of images shall be sufficient for creating a complete notion of the design.When compiling a design application, in a set of essential features we typically indicate only those features which are necessary to provide compliance of the design with the novelty criterion. Therefore, we can provide the broadest protection to the design.
