Russian Patents (Inventions and Utility Models)
Current Russian Patent Law was adopted in 1992. For the previous 70 years, no private ownership had existed for intellectual property in Russia, let alone the entire Soviet Union. In the past, within the limits of a totally state-controlled economy, an invention made by a Russian inventor was owned by the state, while the inventor could only obtain an author's certificate that did not provide any ownership. When perestroika came, the growing market economy called for a new protection mechanism for industrial property in order to facilitate the development of economic enterprises under new conditions. Therefore, the Patent Law of 1992 was passed to bring intellectual property protection into compliance with International practice.
The Russian Federation's Patent Law provides protection for a period of 20 years for an invention, 5 years with possible extension for 3 years for a utility model, and 10 years with possible extension for 5 years for an industrial design. The requirements for patentability and general principles of drafting patent applications are close to these of the European Patent Office. Claims shall preferably be drafted in a two-part form. There is a deferred examination in Russia, i.e. examination can be requested within 3 years from the filing date in Russia, or, in case of a PCT application, from the international filing date.
